Terms and Conditions

1. Flexiretainer Agreement

The Flexiretainer is a 12-month commitment for ongoing development and support services. By subscribing, you agree to the monthly recurring payment for the selected plan.

2. Service Hours

  • Hours are allocated monthly based on your selected plan (16, 32, or 50 hours)
  • Unused hours roll over for 30 days from the month they were earned
  • Hours expire after the 30-day rollover period
  • Hours cannot be refunded or exchanged for cash value

3. Payment Terms

  • Payments are processed monthly via Square
  • First payment is due upon signup
  • Subsequent payments are automatically charged on the same date each month
  • Failed payments may result in service suspension

4. Commitment Period

The Flexiretainer requires a 12-month minimum commitment. Early termination may incur penalties equal to 50% of the remaining contract value.

5. Service Scope

Flexiretainer hours can be used for any CleverOps services including:

  • Business automation development
  • Marketing automation setup
  • Website development and maintenance
  • System integration
  • Consulting and strategy sessions

6. Renewal

Your subscription will automatically renew for another 12-month term unless cancelled with 30 days written notice before the end of the current term.

7. Modifications

Plan changes (upgrading or downgrading) can be made with 30 days notice and will take effect at the start of the next billing cycle.

8. Liability

CleverOps liability is limited to the monthly subscription amount. We are not liable for any indirect, incidental, or consequential damages.

9. Confidentiality

Both parties agree to maintain confidentiality of proprietary information shared during the engagement.

10. Governing Law

This agreement is governed by the laws of Victoria, Australia.
